Family Pet Custody Following Divorce Proceedings

According to a 2022 survey, 52% of UK adults now own a pet with 27% owning a dog and 24% a cat. Pets often become an integral part of the family unit. So, what happens to the pet when the family unit breaks down?

Although we may not consider our beloved pet to be on par with a table or a sofa (aka ‘chattels’), within divorce proceedings, pets have the same status as chattels and courts treat them as such.

If you can’t agree with your partner about your pet, the next step would be to consider mediation.  If that fails, consulting a solicitor to negotiate an agreement with your partner may assist in resolving the dispute.

Whilst UK courts have powers to deal with ‘chattels’, there is no law that states who gets to keep the family pet.  The court will look at who bought the pet, whose name is on the microchip, who pays the vet bills, insurance etc. 

When Ant McPartlin (Ant & Dec) and Lisa Armstrong split up, the court granted them shared custody of their dog, Hurley, however using the court route can be time consuming and expensive for both of you and should only be seen as a last resort.
