Emergency Will Writing

Whilst we always encourage clients to make a Will while they are in good health, there are circumstances where a Will becomes an urgent priority.  A terminal diagnosis, a sudden deterioration in health or an unexpected change in circumstances can make it essential to put arrangements in place without delay.

We were contracted recently by a client with a terminal diagnosis who was anxious to ensure their affairs were in order.  They needed a Will prepared within a very short timeframe and were understandably concerned about the process.

In a scenario such as this when personal circumstances can change quickly, we can adapt the arrangements and visit the client to take necessary instruction.  Following a detailed discussion, instructions were taken on a Thursday afternoon, and the Will was drafted that evening. The following morning, we returned to the hospice to ensure the Will was checked and signed.

The Will was successfully completed on the Friday, providing the client with much-needed peace of mind.  Sadly, they passed away within a matter of days but had the Will not been completed in time, their estate would have passed under the rules of intestacy, potentially benefiting people they had not intended to include.

This situation highlights that emergency Will writing is about far more than preparing a legal document. It is about listening to clients, understanding their wishes and acting with compassion, sensitivity and urgency at a particularly difficult time.  Having  a valid Will in place can provide reassurance to clients and their loved ones, allowing them to focus on what matters most.
