Conveyancing steps when buying freehold property

Here’s a rundown of the conveyancing process with regard to buying a freehold property: 🏡

  • Get Your Solicitor on Board: Found a place you love? When you have instructed a conveyancing solicitor the estate agent will send them the Memorandum of Sale with all the relevant details like price and solicitor info for both parties.
  • Draft Contract Pack: The seller's solicitor will send a draft Contract pack to yours. This includes the draft Contract, title info, a list of what’s included with the property, and any other important docs.
  • Search Time: Your solicitor will run some checks, including a local search for planning info, an environmental search, and a water and drainage search to confirm everything's in order.
  • Reviewing the Pack: Once the draft Contract pack is in, your solicitor will dig in and ask any questions. Meanwhile, don’t forget to book a survey and sort out your mortgage!
  • Final Title Report: After getting all the responses and search results, your solicitor will give you a final title report. This will cover any property restrictions and include the documents for you to sign.
  • Signing and Deposit: Time to sign those papers and pay your deposit (usually around 10% of the purchase price). You’ll also need to let your solicitor know your preferred completion date.
  • Exchanging Contracts: When the completion date is set, your solicitor will exchange Contracts with the seller’s solicitor. This locks everything in—no backing out! Also, time to get your buildings insurance sorted.
  • Funding Completion: Your solicitor will ask your mortgage lender for the funds and let you know if you need any extra cash for completion. They’ll do some final checks with the Land Registry too.
  • Completion Day: On the big day, your solicitor will transfer the funds. Once the seller’s solicitor confirms it, you’ll get the keys to your new home! 🔑
  • After Completion: After you move in, your solicitor will take care of paying stamp duty and registering your ownership at the Land Registry.
